Should this legislation, which goes into effect as of the 1st December 2020, be deemed as illegitimate by the federal constitutional court, the difference between the rent in the contract and the adjusted rent subjected to the ‘rent cap’ is to be paid back immediately. The landlord will demand all open repayments, if at any time the law is announced as illegitimate.
