NO PURCHASE OR BOOKING IS NECESSARY TO ENTER OR WIN. A PURCHASE OR BOOKING WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL APPLICABLE LAWS AND REGULATIONS APPLY. THE CONTEST IS OPEN TO ANYONE WHO IS 18 YEARS OF AGE OR OLDER. ENTRY IN THIS CONTEST CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES (the "Rules").

SPOTAHOME® (the "Company" or "Sponsor"), 4 Months Together (the "Contest") is designed to encourage eligible participants ("Entrant(s)" or "You") to use their creativity, and related skills to submit interesting content generated legally by said Entrants.

THE INFORMATION YOU PROVIDE WILL ONLY BE USED FOR THE PURPOSE OF ENTERING THIS CONTEST, AND, IF SPECIFIED, FOR RECEIVING NEWS AND INFORMATION ABOUT SPOTAHOME® PRODUCTS, SERVICES AND PROMOTIONS.

ELIGIBILITY

To be eligible to enter and win a prize in the Contest, Entrant must be an individual eighteen (18) years of age, the legal age of majority, or older in his or her state of residence. Employees, contractors, officers, directors, and members of Spotahome®, Erasmusu affiliates, and advertising and promotion agencies, representatives, and agents, and their immediate families (spouse, mother, father, sister, brother, daughter, or son) of such employees, contractors, officers, directors, and members are ineligible to participate in this Contest. Contest eligibility is subject to applicable laws and regulations.

The Contest is sponsored by: SPOTAHOME®, with company number B-87004511, located at: Calle de Vizcaya 12, 28045 Madrid, Spain.

The Contest is administered by ShareRoot, Inc. on the behalf of Spotahome® and does not imply any affiliation with any other third-party. This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook, Twitter or any other Social Network.

BINDING AGREEMENT

You agree that submission of an entry in the Contest constitutes full and unconditional agreement to and acceptance of these Rules and the decisions of the Sponsor, which are final and binding. You may not submit an entry to the Contest and are not eligible to receive the prizes described in these Rules unless You agree to these Rules and fulfill all other requirements set forth herein.

CONTEST PERIOD

The Contest begins on 4/24/2018 at 12 AM CEST and ends on 7/24/2018 at 11:59:59 PM CEST (the "Contest Period"). Entries that are submitted before or after the Contest Period will be disqualified.

HOW TO ENTER: NO PURCHASE OR BOOKING NECESSARY TO ENTER OR WIN

Submissions will be accepted during the Contest Period using the Internet submission form and following the steps provided under "How to Enter" or equivalent heading (the "Instructions") found at: https://rent.spotahome.com/4monthstogether ("Contest Site") and also provided below for clarification. You agree that You are solely responsible for finding and operating a compatible web browser to submit Your entry.

Instructions for Entry

a) Post: a video or photo to your Instagram profile. Use the hashtag #4monthstogether and tag @spotahome. Show us how far you would go to win over the city of your dreams. Demonstrate your dedication, give us a laugh.
b) Upload: Visit the contest page (embed this link www.spotahome.com/4monthstogether) and follow the instructions to enter your submission.
c) Share and win: Spread the word! Get your friends to vote for you on the competition page – they’ll have a place to stay when you move to your new city.

Guidelines

a) Upload a video or photo series. Show us how far you would go to win over the city of your dreams. Don't forget to stand out!
b) Use a maximum of 60 seconds for videos and don' submit more than 10 photos (a carousel is preferred)
c) Convince the world that you would do anything to live in your dream city for 4 months.

No purchase necessary to enter or win. There is no restriction on the number of entries an entrant may submit but an Entrant may submit any one video or photo once only. Entries received in excess of the stated limitation will be void. All entries become the property of Sponsor and will not be acknowledged or returned. Limit one (1) prize per person.

ENTRY REQUIREMENTS You agree that You will not post any text, images, audio, or video ("Content") in association with Your entry that contains nudity, excessive violence, or is obscene, offensive or objectionable, or that You do not own the rights to or permission to use.

All entries submitted must be the work of the individual submitting them and must not have been published elsewhere or have won a prize in any other Content.

Furthermore, You agree not to submit any Content that: (a) infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, trade names, industrial designs, patent, trade secret, privacy, publicity or confidentiality obligations; (b) depicts adults, children or other minors without their consent; or (c) otherwise violates applicable laws.

The Sponsor reserves the right to determine and disqualify any entry that does not follow these requirements. Content created or manipulated with third party software is acceptable.

Sponsor, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and employees of are not responsible for late, lost, misdirected, mutilated, illegible or incomplete Contest entries.

PRIZES: 1 TOTAL PRIZES

1st Place - Four (4) months Free rent (1) available

The Contest winner will be awarded four (4) months accommodation in an apartment in the Spotahome® city of their choice.

The maximum rental costs per calendar month (PCM) are €1,000 including utility bills and taxes. Any amounts exceeding the maximum are the responsibility of the prize winner and/or persons signed on the apartment lease. Any amount not paid by the winner will constitute a termination cause of the lease contract with the property.

In case there are administrative costs associated with the rental of the apartment, Spotahome will cover up to €500 taxes included.

The winner can select the apartment of their choice, subject to availability and acceptance of the booking from the landlord.

Spotahome® will pay the deposit on the property.

The winner will be required to sign a contract agreeing to the state and maintenance of the property. The winner must abide by the terms and conditions set out in the contract for the property by the landlord. Should the winner cause damages to the property which result in the landlord keeping some or all of the deposit, the winner will be required to reimburse this cost to Spotahome.

The prize is as stated and no cash or other alternatives will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.

The winner is responsible for their own travel arrangements including, but not limited to, flights, travel to and from airports, food and drink, visas, insurance, personal expenditure or incidental costs and other administrative requirements to live in their chosen city for the four (4) month duration of the prize term. It is the responsibility of the prize winner to ensure they and any guests have a valid passport and travel insurance and obtain any necessary vaccinations and visas for their stay. Winner will bear any personal tax arising from the obtaining of the prize according to his or her personal tax law. In no case, the Sponsor will be responsible.

WINNER SELECTION

After the end of the Contest Period, potential winners will be selected in accordance with the Rules and Instructions. One (1) entry will be awarded prize using the following selection method(s): Spotahome® will select a winner amongst the top entries with that received the most votes. Spotahome® reserves the right to select the winner according to their requirements under the aforementioned present terms and conditions. The judges decision is final and no correspondence will be entered into. The Sponsor will attempt to notify each potential winner via telephone or email within five (5) business days after the Contest Period. If the potential winner cannot be contacted within five (5) days after the date of the first attempt to contact her/him, the Sponsor may select an alternate potential winner in her/his place based on the same selection process among all other remaining eligible entries. Odds of winning are dependent upon the number of eligible entries received during the Contest Period.The Sponsor is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.

WINNER NOTIFICATION

Potential winners will be notified by email or phone ("Notification"). Each potential winner must respond within five (5) days to the Notification or attempted notice or forfeit their claim to her/his prize. If the initial potential winner cannot be contacted or fails to respond to Notification within five (5) days, or makes any misrepresentations with her/his claim, the initial potential winner forfeits the prize. If the potential winner is at least eighteen (18) but is still considered a minor in her/his jurisdiction of residence, Sponsor reserves the right to award the prize in the name of her/his parent or legal guardian, who will be required to correspond with Sponsor and fulfill any other requirements imposed upon the winner set forth herein to redeem the prize.

Potential winners must continue to comply with all terms and conditions of these Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate potential winner based on same selection process among all other remaining eligible entries.

Up to three (3) alternate selections will be held, after which the prize will remain un-awarded. The rental term of the prize must commence within one (1) year of the winner announcement selection. After this time, the awarding of the prize will be at the express discretion of Spotahome.

PUBLICITY

The winner may be required to participate in reasonable publicity on behalf of Spotahome® and Shareroot Inc.

ELIMINATION

Any false information provided within the context of the Contest by Entrant concerning identity, mailing address, telephone number, email address, ownership of right or non-compliance with these Rules or the Instructions may result in the immediate elimination of the Entrant from the Contest.

WARRANTY AND INDEMNITY

Entrants warrant that all Content submitted in associated with the Contest is owned by Entrant or Entrant has the explicit consent to use Content and the right to submit it as part of their entry. Entrants warrant that their entry and associated Content follow all the provisions in these Rules and the Instructions.

To the maximum extent permitted by law, Entrant indemnifies and agrees to keep indemnified Sponsor, its parent companies, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective officers, directors, employees, contractors, representatives, and agents (the "Released Parties") at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the Entrant and/or a breach of any representation and/or warranty set forth herein.

To the maximum extent permitted by law, Entrant agrees to defend, indemnify and hold harmless the Released Parties from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from the participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of any transportation or event, if applicable, or in any Contest-related materials; (e) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Contest of acceptance, receipt of misuse of the prize (including any travel or activity related thereto); (f) any Content provided by Entrant that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy; (g) any misrepresentation made by Entrant in connection with the Contest; or (h) any non-compliance by Entrant with these Rules or the Instructions. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

By accepting the prize, the winner acknowledges that Sponsor has neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or to any portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose.

CONTENT RELEASE

However, by submitting a photograph and/or a video, each entrant grants to Spotahome® a non-exclusive, royalty-free, worldwide, revocable, non-transferable, perpetual licence to use, modify, delete from, add to, publicly display and/or reproduce , the Entrant’s photo, including editing, compiling and assembling video works, interstitials or the use of photographic works as underlying works compiled into moving image without limitation in any online media formats and through any social media channels, pages or accounts. If an entrant’s photo is used on Spotahome’s digital or social platforms (including Spotahome.com), the Entrant’s name will be credited. Spotahome® may also choose at their sole discretion to link back to the Entrant’s website or business social media profile. Spotahome may, at its discretion attach logos or other branding devices on photos or videos.

Entrants can revoke this licence at any time by contacting Spotahome in writing at [email protected] and informing Spotahome® that they no longer want Spotahome to use the photo."

Each Entrant warrants that his/her entry does not infringe any third party intellectual property rights and that s/he is entitled to grant the licence set out above.

RIGHT TO CANCEL, MODIFY OR DISQUALIFY

If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Sponsor further reserves the right to disqualify any Entrant who tampers with the submission process or any other part of the Contest or Contest Site. Any attempt by an Entrant to deliberately damage any web site, including the Contest Site, or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such Entrant to the fullest extent of the applicable law. Failure by the Sponsor to enforce any provision of these Rules shall not constitute a waiver of that provision.

TAXES

AWARDS OF PRIZES TO POTENTIAL WINNERS ARE SUBJECT TO THE EXPRESS REQUIREMENT THAT THEY SUBMIT TO SPONSOR ALL DOCUMENTATION REQUESTED BY SPONSOR TO PERMIT IT TO COMPLY WITH ALL APPLICABLE TAX REPORTING ALL PRIZES WILL BE NET OF ANY TAXES SPONSOR IS REQUIRED BY LAW TO WITHHOLD. TO THE EXTENT PERMITTED BY LAW, ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. In order to receive a prize, potential winners may be required to submit tax documentation requested by Sponsor or otherwise required by applicable law, to Sponsor or a representative for Sponsor or the relevant tax authority, all as determined by applicable law. If a potential winner fails to provide such documentation or comply with such laws, the prize may be forfeited and Sponsor may, in its sole discretion, select an alternate potential winner.

DISPUTES

Judge decision will be final and binding. Nevertheless, in the event of disputes, except where prohibited, each Entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, by the appropriate court All issues and questions concerning the concerning the construction, validity, interpretation and enforceability of these Rules, Entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Spain, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Spain.

GENERAL CONDITIONS

Spanish laws and regulations apply. Sponsor reserves the right to disqualify any Entrant from the Contest if, in Sponsor's sole discretion, it reasonably believes that the Entrant has attempted to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other Entrants or the Sponsor.. If any provision of these Rules are determined to be wholly or partially unenforceable, it will be deemed replaced by an enforceable provision that as nearly as possible reflects the terms of the unenforceable provision or part thereof. These Terms and Conditions are to be interpreted in accordance with Spanish law and any dispute arising out of these Terms or their subject matter is subject to the exclusive jurisdiction of the Spanish Courts.

PERSONAL DATA PROTECTION

Entrants’ personal data will be processed in accordance with the Law 15/1999 of December 13, of Personal Data Protection (“LOPD” in Spanish) SPOTAHOME, SLU, with registered office at Vizcaya Street, 12, 28045 Madrid, informs that Entrants’ personal data will be treated by SPOTAHOME and Entrants expressly acknowledge said treatment in order to participate in the present Contest. Said personal data will be stored in a file responsibility of SPOTAHOME, S.L.U. in accordance with the mentioned Regulation and will be subject to the security measures established by the Spanish Regulation. Besides, in order to comply with the aforementioned regulation SPOTAHOME, S.L.U. informs the Entrants that their personal data will be treated, for the strict purpose of the Contest, by SHAREROOT, INC, a company incorporated under the Laws of USA which will be subject to the requirement established by Spanish Law for the present purpose.

Purposes of treatment and assignments of the data of the interested parties:

a) The data of the Entrants will be processed by SPOTAHOME, S.L.U. with the following purposes: * Manage your participation in the Contest, verifying in case of winning, that the interested party meets the requirements and authorizations necessary to participate. * Provide the interested party with the necessary information so that their participation is in accordance with these Terms and Conditions of the Contest * Communicate the status of winner and deliver the corresponding prizes.

Also, your data may be transferred to the Tax Authorities, if necessary, in order to practice the tax withholding that may apply by Law.

b) Consent of the interested party for the treatment and transfer of his data. Given the mandatory nature of the content of the treatment of the personal data of the interested party, the registration and participation in the Contest implies full express acceptance of the indicated treatment purposes and of all assignments of your exposed data.

c) Exercise of rights of access, rectification, cancellation and opposition The Participants may exercise the rights of access, rectification, cancellation and opposition by writing to SPOTAHOME, S.L.U. and attaching a photocopy on both sides of your Identity document to the following address: C / Vizcaya, 12, 28045 Madrid.
