SPOTAHOME PROMOTION PROGRAM: “REFER A FRIEND” LEGAL TERMS AND CONDITIONS TO PARTICIPATE IN THE PROMOTIONAL CAMPAIGN CALLED “REFER A FRIEND” 1.- ORGANISING COMPANY The company Spotahome S.L.U with address at C/ Vizcaya 12, 28045 Madrid and tax identification number B87004511 launches the campaign “Refer a friend” (hereinafter, “the Promotion”) to be implemented online and for ANY person of legal age in accordance with the provisions set forth in the section where the conditions to participate are stated. 2.-START DATE AND END DATE The campaign “Refer a friend” shall begin on the 1st October 2019 and shall end on the 31st of December 2021. 3.- REQUIREMENTS TO PARTICIPATE AND PROCESS The requirements to participate are the following: Those who are over the age of 18 may participate in the campaign. Own personal data and data from the referred person with which the participants fill in the form shall be truthful data. Participants shall register only once in this promotion. Nevertheless, they may refer as many people as they wish and shall receive the reward corresponding to the number of landlords or tenants referred to Spotahome, provided that; If the referee is a Landlord, the accommodations has been verified by a Home Checker and has been already advertised with Spotahome. Referred landlords shall be new landlords or landlords who have not rented their property -or properties- within the last 6 months with Spotahome. If the referee is a Tenant, he/she has moved into the property booked through Spotahome. Referred Tenants must have registered with Spotahome for the first time. Spotahome only manages residential rentals (houses, flats, rooms in shared apartments and rooms in student residences). Vacation rental properties are excluded from the promotion. Properties shall be located in any of the following cities: Madrid, Barcelona, Valencia, Brussels, Rome, Milan, Berlin, London, Dublin, Lisbon and Paris. Landlords shall hold a proof on the ownership of the property or any other title authorising the Landlord to rent the property. Spotahome may request such proof or title for verification purposes if necessary. The Promotion process consists of the following steps: PERSON A provides truthful contact information about another PERSON(S) (B, C, D…) being the owner of one or several properties (houses, flats, rooms in shared apartments or student residences) for rent in the aforementioned cities or from a potential tenant. Spotahome shall email PERSON(S) (B, C, D…) who have been referred by PERSON A in order to inform about the referral. The above conditions must be met to be able to obtain the reward. The prize consists of a reward for the value of €30/£30 (+ pertinent taxes) for referer and €30/£30 for referee.The payment shall only be made to PERSON A when the photo session has taken place and Spotahome has the visual material and the referred landlord has agreed to advertise his property on the Spotahome or when the referred tenant has moved in to the property. 4.- PROMOTION CONDITIONS AND REWARD The participants shall be notified that have become winners of a prize/reward, individually and via email, every Monday starting on the 1st October 2019 until the 31st of December 2021. Each participant shall receive the value of €30/£30 as prize/reward which shall be paid via bank transfer to the bank account provided. 5.- LIMITATIONS In the event that a participant does not comply with the requirements demanded by the terms and conditions or the data provided to participate is not valid, such participation shall be considered null and the participant shall be automatically excluded from the Promotion, and shall lose all rights to receive prizes granted in accordance with this Promotion. The prize/reward granted shall not be transferable or subject to changes, alterations or compensations upon the request of the Participants, and the prize/reward shall not be exchanged for any other product. SPOTAHOME S.L.U reserves the right, in case of good cause and prior legal notice, to change, suspend or extend this Promotion. The winner shall be responsible for any tax burden arising from the acceptance of the prize, as well as for any other expense derived from the promotion and not expressly undertaken by SPOTAHOME S.L.U in the legal terms and conditions herein. A term of FIFTEEN (15) calendar days from the date of award of the prize is set to make any reasonable complaint. SPOTAHOME S.L.U reserves the right to replace the prize with another one of similar characteristics if needed. 6.- POSTING OF COMMENTS AND OPINIONS Comments or opinions whose content is considered inappropriate, offensive, abusive or discriminatory or which could infringe third party rights shall not be allowed. Comments against anyone violating the principles of right to honour, to personal and family privacy and personal image shall also be banned. Spotahome shall not be liable for any damage caused by comments from participants regarding the Promotion as well as by comments that, at any time, could offend other participants. 7.- LIABILITY DISCLAIMER Spotahome shall not be liable for, including but not limited to, loss, theft, delay or any other circumstance attributable to third parties that may affect the development of this Promotion. Spotahome shall not be responsible for the use made by the participant with respect to the prize granted by this Promotion and takes no liability for any damage or injury of any kind which may be suffered by the Participants, the winner and third parties. Spotahome shall not be responsible in case of force majeure or unforeseen circumstances that could prevent the development of the Promotion or the total or partial benefit of the prize. In the event of failure to carry out this Promotion, either due to detected fraud, technical errors, or any other reason outside the control of SPOTAHOME S.L.U affecting the normal development of the Promotion, Spotahome reserves the right to cancel, modify or suspend the Promotion, including the participation website. 9.- PERSONAL DATA PROTECTION The PERSON A is the processor of the personal data of the person referred and is the one responsible for collecting the information, of its accuracy and for obtaining the consent for processing his/her data. SPOTAHOME S.L.U. takes the protection of their privacy and their personal data very seriously. Therefore, their personal information is kept safely and treated with the utmost care. In accordance with the provisions of the applicable regulations on data protection and specifically on the Regulation (EU) 2016/679 of the European Parliament and the Council of 27th April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, the Participants who accept these Legal Terms and Conditions agree that the data provided to participate in this contest is added to a file owned by SPOTAHOME S.L.U in order to process participation in the contest and to inform the Participants of the prize in case of becoming the Winner. Spotahome states that the personal contact data shall be used for the following purposes: Management of the participation in the Promotion as processor (PERSON A) and referred landlord or tenant (PERSON B), granting of the prize to the provider, if applicable, as well as contact and management of the information about the referred landlord in order to advertise his property on our website. Participants shall guarantee that the personal data provided is true and they are responsible for giving notice to SPOTAHOME S.L.U on any modification thereof. SPOTAHOME S.L.U reserves the right to exclude from this promotion any Participant who has provided incorrect data or data from third parties without any connection that could justify the provision of such data. Having the maximum diligence on Data Protection with security tools is highly recommended, and SPOTAHOME S.L.U shall not be held responsible for any theft, modification or unlawful loss of data. Participants shall have the right to: (i) access their personal data, as well as (ii) request the rectification of inaccurate data or, when appropriate, request its elimination (iii) request to limit the processing of their data (iv) reject the processing of their data and (v) request its portability. Participants may withdraw their consent at any time. Participants may also exercise any of these rights to the following email privacy@spotahome.com. Notwithstanding any other administrative appeal or legal action, Participants shall have the right to submit a complaint at a Control Authority, in particular in the Member State in which their residence, place of work, or place of alleged infringement are located, in the event that the processing of their personal data does not comply with the regulations, as well as in the event that the exercise of their rights has not been fulfilled. The Control Authority to which the complaint was submitted shall inform the complainant about the action taken and the outcome of the complaint. The Courts of the city of Madrid (Spain) shall be eligible to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfilment of these legal terms and conditions.
